1. Acceptance of Terms

By accessing or using our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

ArchRender.ai provides AI-powered image transformation and rendering services for real estate and home design purposes. Our services include image editing, rendering, and visualization tools.

3. User Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. User Conduct

You agree not to use our services for any unlawful purpose, to upload harmful or inappropriate content, or to interfere with the proper functioning of the service. We reserve the right to terminate accounts that violate these terms.

5. Intellectual Property

Your uploads. You retain all ownership rights in the images, sketches, models, prompts and other content you upload or submit to our services (“Inputs”).

Your renders. As between you and ArchRender, you own the images, videos and other results generated by our services from your Inputs (“Outputs”). To the extent we have any rights in your Outputs, we assign those rights to you. Some Outputs may not be eligible for copyright or other intellectual property protection under applicable law, and we don’t guarantee that any such protection exists.

Commercial use. You may use your Outputs for any lawful purpose, including commercial purposes such as client presentations, marketing, listings, advertising, publication and resale, without attribution to ArchRender and without any additional fee.

Our license to your content. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit and display your Inputs and Outputs, and to share them with the service providers that help us run our services, solely as necessary to provide, secure and support our services for you. We do not use your Inputs or Outputs to train AI models or to improve our services, and we do not use them in our marketing, without your permission. This license ends when you delete the content or your account, except for copies we must keep to comply with the law, and for copies in backups that are deleted in the normal course.

Your responsibilities. You are responsible for your Inputs and for how you use your Outputs. You confirm that you own or have the rights and permissions needed to upload your Inputs and to use them with our services, and that doing so won’t infringe anyone else’s rights.

Similar results. Because of how AI works, our services may generate Outputs that are the same as or similar to Outputs generated for other users, especially from similar Inputs or prompts. Your ownership of your Outputs doesn’t extend to Outputs generated for other users, and we don’t guarantee that any Output will be unique or exclusive to you.

Our property. Our platform, software, models, branding and technology remain our intellectual property (or that of our licensors). These terms don’t give you any rights in them except the right to use our services under these terms.

6. Payment and Credits

Certain features require credits which can be purchased through a recurring subscription. All purchases are final and non-refundable unless otherwise required by law. You can cancel your subscription at anytime.

7. Disclaimers

Our services are provided “as is” without warranties of any kind. We do not guarantee that our services will be uninterrupted, secure, or error-free. AI-generated results may vary and should be reviewed before use. We make no warranty that Outputs are free of, or will not infringe, the intellectual property or other rights of third parties, and you are responsible for reviewing Outputs before you use, publish or sell them.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services.

9. Termination

We may terminate or suspend your access to our services at any time, with or without cause. Upon termination, your right to use the services will immediately cease.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes. Continued use of the service after changes constitutes acceptance of the new terms.
